The government presented the Communal Land Rights Act (CLaRA) as legislation that would offer redress to people living in the former Bantustans, as envisioned in Section 25 (6) of the Constitution. However, in reality, the Bill undermined rural people’s security of tenure. CLaRA was struck down by the Constitutional Court in 2010. There is currently a lacuna in terms of legislation that addresses rural people’s security of land tenure.
