Update: Communal Property Associations Amendment Bill (B12-2017)

The Communal Property Associations Amendment Bill  seeks to amend the Communal Property Associations Act to strip CPAs of their landownership.

The Bill is currently in the National Assembly, before the Portfolio Committee on Rural Development and Land Reform. During November 2017, the Committee heard responses by the Department of Rural Development and Land Reform to public submissions made on the Bill.  To fully understand the thinking behind the Bill and what it seeks to achieve it should be read in conjunction with the draft Communal Land Tenure Bill.     As currently worded the CPA Amendment Bill is unlikely to pass constitutional muster as it constitutes a taking of property rights without compensation.
