The Traditional and Khoi-San Leadership Bill (TKLB) aims to combine all the legislation on traditional leadership and recognize Khoi-San leaders and communities.
It seeks to authorize traditional councils to enter into binding contracts with third parties in respect of communal land without requiring the consent of those whose land rights would be directly affected. As such it is unlikely to pass constitutional muster. After a series of hearings across the country, the TKLB was passed by the National Assembly on 7 November 2017, despite opposition from the public. The Bill has been referred to the National Council of Provinces, which is expected to start its own public participation process soon. The different provincial legislatures are also expected to engage in their own public participation processes.
